I Thought I Was Going To Die!
“This neighborhood is like an expressway,” Janine groaned as she stepped onto the lawn, cars roaring in the near distance. “Thank goodness for the little garden oasis I’ve created in my backyard.”
The traffic sounds almost disappeared in the magnificent surroundings. Bulgarian vines, English roses, soft lantern lighting, and a sparkling fountain.
“I’ve got my soothing eye pack and ocean sounds on my headset. This is the life.”
Janine got cozy in her lounge chair and drifted off into a deep relaxation. So deep that she didn’t notice the piercing sound of Herb Bradley’s squealing Corvette on the next street.
Herb was in a big rush. And he had no patience for slow drivers. He weaved through the traffic at high speed.
“WILL YA LEARN HOW TO DRIVE, BUDDY?!!” Herb yelled out the window as he honked his horn repeatedly.
As Herb got closer to Janine’s house, the honking stirred her from her peaceful state.
She peeked through the ferns. “Holy smokes! That guy’s driving like a maniac. If he’s not careful he’s going to…”
CRAASSHHHHHH!!!
Janine watched in horror as Herb smashed into an oncoming car.
But his corvette still didn’t stop!
The collision propelled the car right onto Janine’s property, trampling her precious roses.
Herb tried in vain to get his hands back on the steering wheel. But he was too dizzy from the crash.
“Oh no! I can’t control my car!” Herb gasped.
Janine’s eyes widened in agonizing fear as she watched the car coming straight for her. Her life flashed before. She was a split second away from death…
Miraculously, Herb managed to stop the car just two feet away from Janine.
Janine fainted on the spot.
There were no physical injuries but Janine was traumatized by the near accident. “My life will never be the same. I’m suing that crazy driver for damages from mental distress.”
IN THE COURTROOM
Janine was still distraught,
“Your Honor, I’m scared to leave the house. I can still see that car coming at me. Herb was driving carelessly. Otherwise, he wouldn’t have ended up on my lawn. It was pure luck that he didn’t kill me. Make him pay for my trauma.”
Herb was apologetic, “Your Honor, this was an unfortunate incident. I got into a little accident and my car ended up on Janine’s lawn. But she didn’t get hurt, so there’s no case.”
Is Herb responsible for Janine’s mental distress? YOU! Be The Judge. Then, look below for the decision.
THE DECISION
“Herb, you are responsible for Janine’s condition,” the Judge ruled. “Your careless conduct caused Janine to reasonably fear for her safety. You owe her damages for fright and shock even though there were no physical injuries.”
