Bath town board minutes

Dec. 11, 2006 7 p.m.

Present: Supervisor Fred Muller; Councilpersons William Glosick, Dean Kropp, Robin Lattimer, Albert Burns; Attorney Jeffrey Squires

Supervisor Muller opened the regular meeting of the Bath Town Board at 7 p.m. with the pledge of allegiance to the flag.

Kelly Fitzpatrick gave the auditor’s report for 2005. The Town of Bath has total net assets of 2.7 million dollars. She presented a statement of financial activities. Ms. Fitzpatrick stated that Bookkeeper, Lee Ann Dickey, does a very nice job on the Town’s books. The auditor gives the town reasonable assurance that the books are free of issues. The Town of Bath has no unusual accounting practices and the auditor has no disagreements with management. Bookkeeper Dickey is doing a good job setting up a Quick Books program and was commended for taking her time to set it up correctly.

She recommended setting up a capitalization threshold for equipment with a purchase price of somewhere less than $2,500 to $5,000.

Department heads need to sign all vouchers. She suggested that since the Town Clerk audits the vouchers, the Supervisor should approve that offices expenditures. She also said to try to take advantage of any discounts available to the Town.

Old Business:

Supervisor Muller met with Code Enforcement Buckland and the Health Department. They said all septic plans must be drawn up and stamped by an engineer beginning Jan 1, 2007. He and Mr. Buckland will be attending a meeting on December 19, 2006 with Allen Engineering to look at boiler plate prints of septic designs that have been approved by the Health Department. Fagan Engineering also has plans available. The Town can purchase plans from Allen Engineering for use by residents at the cost of $500. Residents can use them if they need to install a septic system. If the individual had to purchase the plans the cost could be up to $1,500.

Senior citizen and disability tax exemptions in the town are currently at $19,500 and the county exemptions are at $22,500. Supervisor Muller would like to address this at the next town board meeting.

Mr. Muller suggested the town might like to consider a performance bond from anyone working in the town roads which would entitle the town for reimbursement for damage to the roads.

Resolution 21-06

Presented by Councilman Burns, seconded by Supervisor Muller, to designate “One Arc Way” as a private driveway for use by Steuben ARC.

New Business:

Resolution 22-06 presented by Councilperson Lattimer, seconded by Councilman Burns, to relevy two items to the Town and County tax bills. $365.75 Buck Meadows for sewer charges; $12,345.17 Southview Manor for water charges

Communications:

The Supervisor received a thank you from residents on Lake Salubria Drive for the striping job done on the road.

Mr. Muller received word from Time-Warner Cable of the possibility of losing some channels from their programing schedule.

The Steuben County Youth Bureau is looking for nominations to recognize a youth service worker who has done an outstanding job assisting youth.

Nominations for an outstanding resident for the Steuben County Hall of Fame must be submitted by Dec. 31, 2006 for induction into the Hall of Fame for 2007. Applications for both awards are in the office of the Bath Town Supervisor.

Planning Board Chairman, James Emo: The Planning Board met Dec. 5, 2006 at 7:30 p.m. Engineer Jody Allen presented a site plan review for ARC to expand their building in the Industrial Park.

Steve Orcutt, representing Steuben County, presented a minor subdivision for Richard and Delores Ellison across the road from the Steuben County landfill. The County plans to purchase 2.6 acres on the Turnpike Road from 3.86 acres.

Douglas and Karen VanDyke filed a minor subdivision on Buck Settlement splitting 3.8 acres from 102.75 acres. The subdivision was approved by the Planning Board.

Attorney Plaskov applied for a minor subdivision for Frank Judd on Longwell Lane. Cornerstone wishes to buy a strip of land 10’ X 150’ containing a well. The map submitted was unacceptable and returned for correction.

Dollar General’s permits are in order. Chairman Emo asked Code Enforcement Officer Buckland to forward pictures of the building to the Planning Board when they submit their plans to him. They have changes engineers since the project started.

Code Enforcement Officer, Al Buckland: He gave his report for November 2006. He asked for permission to purchase a cabinet since the Village Building Inspector has moved out of the shared office. The cost of the 10 drawer cabinet is $1,437.04. He has enough money left in his budget to purchase the equipment.

Motion by Councilman Kropp, seconded by Councilperson Lattimer, to authorize Code Enforcement Officer Buckland to purchase a ten drawer cabinet at the cost of $1,437.04.

Highway Superintendent, James McGlynn: Scott Travis and Jim McGlynn took the incident command training course that is required of public officials. The highway department has been repairing roads, cleaning ditches, and hauling sand. Superintendent McGlynn feels there should be notification to residents working in the roadway that they need a permit from him. Perhaps information could be distributed when a building permit is issued.

Dog Control Officer Ruth Tuttle: She gave her report for November, 2006.

Land Use Regulations Committee Chairman Bill Hudson: He stated two meetings have been held, November 27 and December 3. He suggested extending the current adult use moratorium.

He is working on wording concerning adult use. Next meeting will be held December 18, 2006 and will pertain to Agriculture and Tourism.

Attorney, Jeffrey Squires: He presented the lease agreement between the Town and Village of Bath in the amount of $22,575.00 for 2007.

The Public Hearing for the fire contracts was scheduled for January 8, 2007 prior to the regular Town Board meeting. The year end meeting will be held December 28, 2006 at 4 p.m. and the re-organizational meeting will be Jan. 4, 2007 at 7 p.m.

Attorney Squires stated that Mr. Templin has been served with papers for damage to the Turnpike Road.
