Bath town board minutes

Editor's note: The following is an excerpt of the Aug. 13 minutes of the Bath town board, which board members have not yet approved.

Present: Supervisor Fred Muller; Councilpersons William Glosick, Dean Kropp, Robin Lattimer and Albert Burns; Attorney Jeffrey Squires

Also Present: Acting Highway Superintendent Scott Travis; Highway Crew members Fred Finch, Roger Knowles, Craig Smith, and Mike Palermo; Planning Board Chairman James Emo; Planning Board Member John Lysyczyn; Code Enforcement Officer Al Buckland; Comprehensive Plan Acting Chairman Hal Bailey; Village of Bath Trustees Tom Sears and Mike Skelley; Auditor Kelly Fitzpatrick; Town Clerk Marcia Burns.

The regular meeting of the Bath Town Board was opened by Supervisor Muller at 7:00 PM with the pledge of allegiance to the flag at 7:00 PM.

Motion by Councilman Kropp, seconded by Councilman Glosick, to approve the minutes from July 9, 2007.

Approved unanimously.

Mr. Muller announced the addition of a resolution for Justice Court to the agenda.

New Business:

Supervisor Muller introduced Auditor Kelly Fitzpatrick, who gave the auditor's report for the year 2006. She stated the Town of Bath is in good fiscal condition. She presented a sample resolution for the Town Justice Court acknowledgment that a records examination was conducted. She also reported that the Town Justice office has performed the duties of receipt and disbursement of monies as prescribed by the law.

Resolution 07-21

Presented by Councilperson Lattimer, seconded by Councilman Glosick, to acknowledge that the required examination of the Town Justice records was conducted for the year ended December 2005.

Resolution 07-22

Presented by Councilperson Lattimer, seconded by Councilman Glosick, t o acknowledge that the required examination of the Town Justice records was conducted for the year ended December 2006.

Mike Buck inquired about a piece of property on East William Street Extension that belongs to the Town of Bath. He would like the .135 acres conveyed to him to clean up and level. The Town Board tabled the issue until they have time to look at the property and consider. Supervisor Muller suggested the Town retain the mineral rights.

Resolution 07-23

Whereas the State of New York has established a Justice Court Assistance Program for which the Town of Bath and the Village of Bath are eligible.

Now, Therefore, upon consideration of the Town Board of all information relevant to this matter and upon hearing all of the persons wishing to be heard thereon and upon a motion duly made and seconded and unanimously carried, it is hereby

Resolved that the Town Board of the Town of Bath authorizes Karen Longwell, Court Clerk, to make application to the Uniform Justice Court System for a Justice Court Assistance Program Grant jointly with the Village of Bath and authorizes the Supervisor to execute the certification on the agreement on behalf of the Town of Bath.

Motion made by Councilman Kropp, seconded by Councilperson Lattimer, to authorize the Supervisor to execute the agreement on behalf of the Town.

Town Clerk Burns advised the Town Board of the intention of Steuben County Veterans' Memorial Inc; Bath Rod & Gun Club; and Club Valentine to renew their liquor licenses with the New York State Liquor Authority.

Old Business: None

Communications: Jennifer Saltsman, Administrative Assistant, advised Supervisor Muller that Ira Davenport Hospital is holding a 10K race September 8, 2007 from 9:00 AM to 12:00, closing part of the Fish Hatchery Road.

Department Reports:

Planning Board Chairman, James Emo reported the regular meeting of the Bath Town Planning Board was held Tuesday, August 7, 2007 at 7:30 PM in the High School cafeteria.

Serv-U Credit Union presented a site plan for review. They were referred to the Code Enforcement Officer to obtain a building permit.

The Planning Board accepted lead agency for a proposed Walmart Supercenter. The scoping meeting will be held August 23, 2007 at the Civil Defense Building at 7:00 PM. The Scoping documents are on file in the Town Clerk's office.

The Planning Board declared a Positive Impact for the Walmart people to respond to.

Acting Highway Superintendent, Scott Travis: He reported that grading and mowing are finished for the first time. They are graveling on Velie Road, Snell Hill Rd and hot paving is being done on Spaulding Drive and Dusenberry Road.
