Bath man dies in I-86 accident

BATH - A Bath man was killed Tuesday, Feb. 19, the Southern Tier.

Timothy N. Soles, 32, of Bath, was killed shortly before 8 a.m. Tuesday as he attempted to change a flat tire on Interstate Highway 86 in Bath.

Soles was struck and killed by a tractor-trailer as he changed a flat tire on the eastbound shoulder of I-86, state police in Bath said. The rear fender of the truck struck the man.

The driver, Derek Rivard, 32, of Ontario, Canada, told troopers he did not see Soles because of a glare created by the sun.

"The troopers that were there at the time obviously could see the same glare," said state police Sgt. Mark Cleveland.

Soles was pronounced dead at Strong Memorial Hospital in Rochester.

Rivard was issued tickets for log-book and equipment violation s but will not face charges in connection with the crash, troopers said.

"Neither of which (violation) contributed to the crash," Cleveland said.

The investigation is on going.
