  • Eric Smith’s parole hearing has been postponed until next month.

    Smith, who was 13 when he murdered 4-year-old Derrick Robie in 1993 in Savona, had been scheduled to go before the parole board Tuesday.

    Smith, who was 13 when he murdered 4-year-old Derrick Robie in 1993 in Savona, had been scheduled to go before the parole board Tuesday.
    “Eric Smith’s parole board interview has been postponed for one month until May 2012 for completion of records, which includes material submitted to the board by outside parties,” said Carole Weaver, a spokeswoman for the state Department of Corrections and Community Supervision.
    The materials weren’t specified, but they could be anything from victim-impact statements to court documents.
    Smith has been denied parole five times since he was first eligible in 2002.
    If Smith is granted parole next month, he would be eligible for immediate release, pending a review of his release plan, which includes where he’ll live and what he plans to do to gain employment. In a 2006 interview, Smith said he would likely return to Savona if released.
    If the parole board denies release, Smith will remain imprisoned for at least two more years.
    Smith is serving a life sentence for killing Robie after he lured the boy into a wooded area near the boy’s home. Robie was walking alone to a summer camp at a nearby park.
    Smith strangled Robie and smashed the boy’s head with a rock. Also, he sodomized Robie with a stick.
    Smith was a bespectacled redheaded teen with freckles who was often the target of bullies. At trial, his attorney attempted to persuade a jury that Smith suffered from a mental disorder.
    Smith was convicted of second-degree murder in 1994 and sentenced to nine years to life in prison.
    He was housed in a juvenile facility until 2001, when he was transferred to an adult state prison. He is currently serving his time at the maximum security Clinton Correctional Facility in Dannemora.
