Police say Pa. man was arrested, released, then arrested the same day on auto theft charge
CORNING - A man who allegedly trespassed Thursday in the apartment of a Corning woman while naked and walking a dog -- then was charged, released, and arrested later in the same day on charges of stealing a car -- is in Steuben County jail awaiting extradition to Pennsylvania on a probation violation.
Patrolmen responded at about 2:15 a.m. Thursday to a 911 report of a naked man walking a dog who had just trespassed into a West Pulteney Street apartment.
Corning Police Chief Jeff Spaulding said patrolmen arrived at the scene, conducted an investigation and located David E. Walter Jr., 49, of 1950 Jefferson Ave., Lewisburg, Pa., in the area.
Walter was taken into custody and charged with second-degree criminal trespassing for entering the apartment of a female resident, Spaulding said. The resident reportedly armed herself with a kitchen utensil while calling 911 for help.
“(Walter) was brought back to the Corning Police Department, processed, and pursuant to the new state law he was released on an appearance ticket,” Spaulding said.
Corning Police communicated with authorities in Pennsylvania and discovered Walter was on probation.
“Authorities from Union County (Pa.) Probation contacted us and let us know that his probation had been violated based on the (West Pulteney Street) incident, and that he was now wanted in the state of Pennsylvania,” Spaulding said.
Police began a search for Walter.
“He was staying at an area hotel and we were unable to locate him,” Spaulding said. “We continued to patrol for him and at about 3:10 p.m., Steuben County 911 dispatched patrolmen to the area of Bridge Street near Pulteney (Street) for a subject that had just stolen a motor vehicle.”
Spaulding said patrolmen responded, interviewed witnesses and located Walter in the area of East Market Street.
Walter was arrested and charged with third-degree grand larceny. He was arraigned at the Steuben County Centralized Arraignment Court and sent to Steuben County Jail to await extradition to Union County, Pa., on the probation violation charge.
He is scheduled to return at a later date to answer the local charges.
