A man being held in the Steuben County Jail on murder charges allegedly assaulted a corrections officer earlier this month, according to police.

Marland D. Brooks, 39, was charged Tuesday with second-degree assault for allegedly injuring a corrections officer during an altercation the afternoon of Jan. 4. The officer suffered hand and shoulder injuries.

According to the Steuben County Sheriff’s Office, the altercation started when Brooks allegedly failed to comply with corrections officers’ orders.

Brooks has been in jail since June 21, three days after he allegedly killed Clark VanEtten during a drug-related robbery at VanEtten’s South Corning apartment.

According to police, Brooks and Samantha N. Smith, 28, both of Elmira, went to VanEtten’s apartment to rob him of money. Brooks allegedly stabbed VanEtten twice.

Brooks told authorities he killed VanEtten in self-defense.

Brooks is charged with two counts each of second-degree murder and first-degree robbery and a single count of criminal possession of a weapon. He faces life in prison if convicted. He is scheduled to go on trial next week.

Smith was not indicted on murder charges.

VanEtten had a wife and two children.
