Woman failed to protect children

The wife of a Dansville man accused of having deviate sexual intercourse with a child has been charged with failing to protect three children from alleged abuse.

Kimberly A. Volta, 35, of Oak Hill Road, Dansville, was charged Tuesday with three counts of endangering the welfare of a child, a misdemeanor. She was issued appearance tickets and released.

Kimberly Volta is the wife of 36-year-old Joseph Volta III, of the same address, who is charged with having anal sex with a child at least once, specifically May 31 at his home. He was arrested earlier this month after he spent the night in the woods near his home in an attempt to hide from police.

Joseph Volta was hit with additional charges Monday after he allegedly used a Steuben County Jail phone to place approximately 10 collect phone calls to the victim’s family. Sheriff Joel Ordway said that particular phone number was blocked after deputies learned Joseph Volta allegedly made the calls.

According to the charges against Kimberly Volta, she allegedly had knowledge of the alleged abuse by her husband and failed to intervene. She was allegedly first made aware of the possible abuse May 31 and failed to take appropriate actions to remove the child from danger.

The other two charges are related to an incident Nov. 19 when she again allegedly failed to take action to ensure the safety of two other children.

Joseph Volta is being held without bail.

Also, an unidentified 15-year-old boy was charged with sexually abusing a child in connection with the investigation into Joseph Volta.
